Abstract

Legal protection of workers' rights to BPJS Ketenagakerjaan in Pekanbaru is an obligation from employers to employees. Protection of workers in the form of social security BPJS Employment. In accordance with the mandate of Law Number 24 of 2011 concerning BPJS, it also explains the obligations of employers or companies and the obligations of participants, namely employees or workers, to register as BPJS participants and pay BPJS membership dues. This protection is a human right that must be fulfilled by the company but is still experiencing obstacles in its implementation. Such as companies that did not register their workers, Tenant Mall Pekanbaru and PT Indolima Perkasa, which made late payments for the BPJS Employment program contributions. The main formulation in this study is how the legal protection of workers' rights to BPJS Employment in Pekanbaru and what are the legal consequences for companies that do not register their employees to BPJS Employment. This research method, the type and nature of the research is observational research. Empirical research uses legal materials consisting of primary data, namely data obtained directly from sources in the field and secondary data, namely data obtained from library materials which are divided into primary legal materials, secondary legal materials. This research was conducted in this study, the authors obtained from the Main Supervisor of Supervision and Examination of BPJS Employment in Pekanbaru City, Head of Supervision of Work Norms, Social Security for Women and Children at the Riau Province Manpower and Transmigration Office, Administrative Manager of Tenat Mall Pekanbaru and Region Coordinator of PT Indolima Perkasa. The results of this study are 1) The legal protection of workers' rights to BPJS Ketenagakerjaan in Pekanbaru, in the implementation of providing such protection there are several obstacles, for example at Tenat Mall Pekanbaru and PT Indolima Perkasa have not been fully implemented, where all Tenat Mall Pekanbaru workers do not have social security in the form of BPJS of Employment. Meanwhile, PT Indolima Perkasa has participated in the BPJS Employment program so that the BPJS Employment program can be implemented. 2) The legal consequences for companies that do not register their employees with BPJS Employment at Tenat Mall Pekanbaru have received verbal and written warnings, both from BPJS Employment and also the Manpower and Transmigration Office of Riau Province, Meanwhile PT Indolima Perkasa has received a written warning letter from BPJS Employment and an SKK letter from the Kejari in the form of a summons to pay a late fee for BPJS Ketenagakerjaan so that PT Indolima Perkasa pays the BPJS Employment dues in full.
