Abstract

Subsidized fertilizer is highest price fertilizer that has been subsidized by the government so that the price is cheaper. Subsidized fertilizers are submited for farmer groups that according to the farmers' needs. Policy regarding subsidized fertilizer procurement was issued by the Ministry of Trade of the Republic of Indonesia. This research was implemented to identify farmers who receive the subsidized fertilizer, the procurement and distribution of subsidized fertilizers and legal protection for farmers to get subsidized fertilizers. The problems that will be discussed in this thesis are How the Government's Procedure for Supplying Subsidized Fertilizer to Farmers, Inhibiting Factors faced by Farmers about access to subsidized fertilizer procurement and what are the Legal Efforts for Farmers as Consumers if they do not get Subsidized Fertilizer from the Government in terms of the Law No. 19 of 2013 concerning Protection and Empowerment of Farmers. The method was Used in this thesis is survey empirical or sociological legal research. This research was conducted using secondary data that obtained from primary legal material such as analyzing laws and regulations related to the title of this thesis, and secondary legal material such as books, legislation and various magazines, literature, articles, and the internet that relating to the issues was raised in this thesis. The results will showed that the parties involved in the procurement and distribution of subsidized fertilizers were the government, Line I producers, Line II Distributors, Line III Distributors, and Line IV retailers. The mechanism for procuring and distributing subsidized fertilizers is in accordance with the mechanism contained in the Regulation of the Minister of Trade Number 17 / M-DAG / PER / 6/2011 concerning the Procurement and Distribution of Subsidized Fertilizer. Efforts to protect farmers' rights in obtaining subsidized fertilizers were carried out by the government by issuing Regulation of the Minister of Trade Number 17 / M-DAG / PER / 6/2011, Law of Consumer Protection Number 8 of 1999 and it turns out that in the field there are still many farmers who cannot experience the protection they have because the government is not optimal in implementing it.
