Abstract

From the results of observations in the University of Riau, in 2014-2017 the University of Riau has proposed 9 civil servants to be proposed for their dismissal. Where, the reason for the dismissal is because the civil servant commits a criminal offense and commits a disciplinary violation from entering work. However, of the 9 civil servants proposed, the dismissal was only 4 civil servants who were terminated. Thus, it can be seen that the decision to terminate is far less than what has been proposed. Based on Law Number 5 of 2014 concerning the State Civil Apparatus to impose dismissal, it is distinguished according to the basis of dismissal and procedure for termination. The main problems of this research are: first, what is the procedure for dismissing civil servants based on State Administrative Law? Second, what is the implementation of dismissal of Civil Servants in the University of Riau environment. This study uses an empirical juridical approach with data collection through primary data and secondary data. Primary data is done using interviews. While secondary data is obtained by examining primary legal materials and secondary legal materials which are then analyzed using qualitative analysis techniques and interpreted logically and systematically and then drawn conclusions. The results of the study are, that the procedure for dismissal of civil servants based on State Administrative Law is distinguished on the basis of dismissal. Like, civil servants who commit criminal acts, are not the same as dismissal procedures with civil servants who commit disciplinary violations. Besides that, civil servants who commit disciplinary violations are no longer dismissed with no respect, but can be sentenced to termination with respect. While the implementation of dismissal in the University of Riau, that of the 4 dismissals of civil servants for committing a crime, 1 of them has not been in accordance with the procedures for dismissal of civil servants. While the 5 proposals for dismissal of civil servants due to disciplinary violations, not in accordance with the rules for procedures for dismissal Like, at the time of the call that should have been done within 7 working days, it was done more than 7 working days. In addition, the basic consideration of the immediate supervisor is unclear. So that it cannot be known which authority will impose the disciplinary sentence.
