Abstract
The implementation of state financial returns from the proceeds of corruption committed both individually and in groups is one of the tasks of the Prosecutor's Office, because the Prosecutor's Office is authorized by the Law to optimize the role of the Prosecutor as State Attorney in returning state financial losses or state assets through substitute money the result of corruption. Judging from the background above, the formulation of the research problem is; First, about the role of the Bengkalis District Prosecutor's Office in the effort to enforce the law on the return of state finances from corruption committed by the defendant and the obstacles of the Bengkalis District Attorney. Second, law enforcement efforts to restore state finances from corruption committed by the Defendant. Judging from the type of research, this research belongs to the research observational group by surveying is descriptive analytical. The author in analyzing the data based on primary data and secondary data and then deducting conclusions deductively from things that are general to special. The role of the Bengkalis District Attorney in the law enforcement efforts to repay the state from the criminal acts of corruption committed by the defendant has been done well, from 2 (two) corruption cases that were adopted writers, Bengkalis District Prosecutors succeeded in recovering State losses from the Corruption Operations Procurement Project / Sea Patrol at the Bengkalis Regency Sea Transportation Agency with suspected Iwan Eriadi and from the proceeds of criminal acts of Corruption in the Procurement Project of Emori SD / MI Science and Learning System Enchantment of Middle School / MTs Physics, Mathematics Enchantment of Middle School / MTs, High School at the Bengkalis Regency Youth and Sports Education Agency Fiscal Year 2005 with suspect Munjadi HM. Noor. Whereas the Bengkalis District Prosecutor's Obstacles in Enforcement of State Financial Return Laws include: Lack of witnesses who support the verification of corruption cases, the existence of limited facilities and infrastructure in eradicating criminal acts of corruption, the difficulty of investigative audit processes / calculation of state losses by relative authorities for a long time, the mechanism for applying subsidiary subsidies to Article 2 paragraph (1) and Article 3 of the Law on the Eradication of Corruption Crime tended to be inappropriate, there were differences in understanding between public prosecutors and judges in the case of evidence at the Corruption Court, Difficulties in confiscation and tracing assets of the defendant / convicted person in an effort to recover losses of state finances, Time Management of Investigation, Coordination, and the Resistance of Corruption Actors.
