Abstract
According to Law Number Sof 1960 Concerning Basic Agrarian Regulation, the sale and purchse of land rights in Sibuhuan Julu Village, Barumun District, Padang Lawas Regency must be carried out in front of the Land Deed Maker Official (PPAT) but in Sibuhuan Julu Village, Barumun District, Padang Lawas Regencyon in fact, there are still many transfers of land rights that are carried out under the hands, so that the sale and purchase of land is very detrimental to the buyer, because the buyer can only control physical land rights, not legallyownership of the land is still with the seller. The main problem in this research is about the implementation of selling land under the hands of Sibuhuan Julu Village, Barumun District, Padang Lawas Regency and the factors that influence the occurrence of informal buying andof land in Sibuhuan Julu Village, Barumun District, Padang Lawas Regency, The research method used in determining the sample is purposive sampling. descriptive in nature, and the data used are primary and secondary data, namely descriptive analysis by surveying the location chosen to conduct research in Sibuhuan Julu Village, Barumun District, Padang Lawas Regency conducted in interview with the Village Head of Sibuhuan Julu and Mr. Musa Daulay S.H as PPAT in Barumin Distributed questionnaires to the community in Sibuhuan Julu Village, Barumun District, Padang Lawas Regency. From the results of the study, it can be concluded that the sale and purchase of land in the village of Sibuhuan Julu Village, Barumun District, Padang Lawas Regenc. carried out informally, remains legal as the material requirements are met. So that the sale and purchase of land that is carried out not informally in Sibuhuan Julu Village, Barumun District, Padang Lawas Regency has definite legal force in the Basic Agrarian Law, namely by deed of the Deed Maker Official Land (PPAT) is the formal requirement, the people in Sibuhuan Julu Village still use informal buying and selling without being in front of PPAT, the minimal level of knowledge of the transfer of rights, the parties with their belief system, the high cost of buying and selling before the PPAT, and the lack of ignorance of the first party of the seller who holds the land rights for the first time.
