Abstract

Regulation of the Minister of Law and Human Rights Number 9 of 2017 concerning the Application of the Principle of Recognizing Service Users for Notaries, emphasized that Notaries need to apply PMPJ to prevent Money Laundering and Terrorism Financing Crimes. In the process of implementing PMPJ, it was found that there were obstacles that caused PMPJ not to be implemented by a Notary in Pekanbaru. This is what motivates the author to raise the title Application of the Principles of Recognizing Service Users by Notaries in Pekanbaru with the aim of knowing what obstacles are faced and the legal consequences of notaries related to the implementation of this PMPJ. The main problem in this research is what are the obstacles in the application of the Principle of Recognizing Service Users for Notaries in Pekanbaru and the legal consequences of authentic deeds and notaries if they do not apply the Principles of Recognizing Service Users in knowing tappers in Pekanbaru. This research belongs to the normative survey research. While the nature of this research is descriptive. The object of research is the implementation of the Principles of Recognizing Service Users by Notaries in Pekanbaru, to obtain an overview of the successful implementation of these principles and the obstacles faced during the process. The results of this study indicate that the obstacles faced in the process of implementing this PMPJ are the Regulation of the Minister of Law and Human Rights Number 9 of 2017 which imposes a notary on suspicion of the tappers, whether the tappers will commit legal actions before the Notary is the result of suspicious transactions such as money laundering, and notaries. argues that this regulation is forcing a notary to ask privacy questions to his clients and this is contrary to UUJN which obliges notaries to keep the privacy of their clients confidential. Due to the law of a notary who does not apply PMPJ, the notary may be subject to administrative sanctions in accordance with the UUJN, verbal warning, written warning, temporary dismissal, honorific dismissal and dishonorable discharge.
