Abstract
The crime of theft is regulated in Article 362 of the Criminal Code (hereinafter abbreviated to the Criminal Code). Therefore, the state feels the need to protect the rights of its citizens in relation to property. The protection of property rights in the form of property is emphasized in the 1945 Constitution of the Republic of Indonesia Article 28H paragraph (4) which reads "Everyone has the right to have private property rights and such property rights may not be taken over arbitrarily by anyone". The crime of theft is one of the most common crimes in society. Generally the crime of theft that often occurs is ordinary theft, and theft by weight, then followed by violent theft, including muggings and robberies, thuggery, murder, fraud, and followed by crimes of decency. Based on the background above, the formulation of the problems that will be answered in writing this thesis include: How are the efforts to tackle the crime of theft on foreign ships in the Dumai Police area and what are the obstacles to the Dumai Police in dealing with the crime of theft on foreign ships. This writing, when viewed from the type of research, uses sociological research methods by means of surveys, namely research directly to respondents using data collection tools in the form of interviews. Meanwhile, if viewed from its nature, this research is descriptive analytical, which means the research is intended to provide a detailed, clear and systematic description of the main research problems. Efforts to Combat the Crime of Theft on Foreign Ships in the Dumai Police Legal Territory are carried out in a preemptive way, namely the initial efforts of the police (early efforts) to prevent the occurrence of criminal acts with a persuasive approach, by preventive means, namely crime prevention through a non-penal approach, which is more action-oriented. Advanced prevention is carried out before the crime occurs and in a repressive manner, namely after the crime has occurred, namely by giving punishment. Barriers to the Dumai Police in dealing with the crime of theft on board foreign ships due to legal factors, law enforcement factors, facilities and facilities factors, community factors that lack awareness of the law and cultural factors.
