Abstract

Indonesia is a legal state that has the ideals of "protecting the entire Indonesian nation and educating the nation's life, and participating in carrying out world order based on independence, eternal peace, and social justice as stated in the 1945 Constitution, paragraph 4.1. In order to realize the ideals of this nation, it is necessary to carry out a sustainable development in all aspects of life in a comprehensive, integrated and directed manner. The State Administrative Law has several special sections, such as State administrative law in the health sector (medisch bestruusrecht). In carrying out activities to maintain and improve health organized by the government and the community, it is carried out using the services of the health workers themselves. Therefore, legal regulations are needed as the basis for enforcing the health authority. The practice of midwives is not free to stand without a license to practice health workers issued under the authority of the local government, this has been regulated in Permenkes No.28 of 2017. This study aims to determine the cause of the large number of private practice midwives who do not have a license and to get an overview of the completeness of the requirements in obtaining permits based on the Regulation of the Minister of Health (Permenkes) No. 28 of 2017 concerning permits and the implementation of the practice of midwives. This research was conducted in the Sencano Jaya Public Health Center. The object of this research is the Private Practice Midwife operating in the Sencano Jaya Health Center area. This study uses a sociological empirical research method, namely data collection from the Indonesian Midwives Association (IBI) for the Sencano Jaya Branch and the Independent/Private Practice of Midwives in the Sencano Jaya Health Center area by distributing questionnaires and direct observation assisted by the local IBI Branch Chair. The results of this study indicate that of the 19 private practice midwives in the Sencano Jaya Health Center area, only 1 person has a permit, and midwives who do not have a practice permit in general on the grounds that they cannot fulfill the completeness of the practice equipment due to financial limitations and reasons for being far away. reach out to the District Health Office for permit processing. In order to fulfill the requirements for the existing practice facilities and infrastructure, they have not fully met the standards in accordance with the Minister of Health Regulation Number 28 of 2017. From this study it can be concluded that there are still many private practice midwives in the Sencano Jaya Health Center area who do not have a permit because they do not meet the practice requirements as contained in the Minister of Health Regulation No. 28 of 2017 . It is recommended that midwives who carry out private practice must meet the requirements according to Permenkes No. 28 before providing services, and providing guidance and supervision by parties involved in the implementation of these private practice services.
