Abstract
The auction or execution is the final step taken by the creditor. Auction or execution can be carried out if the debtor defaults in accordance with the provisions of Law No. 4 of 1996 concerning Mortgage Rights on land and objects related to land. Therefore, the authors are interested in conducting research with the title "Legal Aspects of Mortgage Collateral Auction in Troubled Financing Settlement at Bank Syariah Mandiri Branch of Pekanbaru City. The main problem in this research is how the mortgage collateral auction process at Bank Syariah Mandiri Branch Pekanbaru through the State Wealth and Auction Service Office (KPKNL) and what are the obstacles that occur during the execution process of mortgage rights at Bank Syariah Mandiri Branch Pekanbaru City. This research is classified as a survey or empirical law. While the nature of this research is descriptive. The object of his research is the Implementation of Auctions at Bank Syariah Mandiri Branch Pekanbaru, to obtain an overview of the successful implementation of the auction and the obstacles faced during this process. The results of this study indicate that the auction process carried out by Bank Syariah Mandiri Branch of Pekanbaru City, if the debtor defaults, then a public auction is carried out through the State Wealth and Auction Service Office or carries out an underhand sale. and auctions are less desirable. The constraints faced are when the execution of the promise to vacate the mortgage object does not run effectively, there is a third lawsuit, the bonding right of the mortgage is not carried out perfectly, interference from third parties during the execution and the mismatch of opinion regarding the auction price between the debtor and the auction official.
