Abstract
Online transportation is a type of service that is found every day and is always used by all people, from young to old using online transportation services. Maxim is an online transportation company, Maxim is an international ride-hailing service. Maxim made a partnership agreement with the driver without involving the driver, the system became quite a tough job, because it was a one-way agreement. Drivers must click agree on the application or terms written there. Not to mention the problem of the tariff set by the maxim that does not match the applicable rules. In this study, the researcher has a main problem to discuss, namely how the implementation of the partnership agreement between the Pekanbaru branch maxim and drivers and the other main problem is what are the factors that make the Pekanbaru branch maxim tariff not in accordance with the decree of the minister of transportation (Kepmen) number 348 year 2019. The research method that the researcher uses in this study is a qualitative research method, namely descriptive data in the form of written or spoken words from people and actors that can be observed. Qualitative research is conducted to explain and analyze phenomena, events and perceptions of a person or group of something. The nature of analytical descriptive research is to provide an overview of the relationship that occurs between these events and the problem to be studied. The results of the research that the author obtained are that the work partner or driver does not have the right to obtain workers' rights in general because based on the elements of the Maxim cooperation agreement the Pekanbaru Branch does not meet the elements of a work agreement but a working relationship on a partnership basis. As for the factors that make the maxim tariff not according to the rules set out, because it is a company strategy, there is competition between online transportation competitors and to attract public interest.
