Abstract
The customary marriage process of the Batak Toba tribe has several stages that must be passed to achieve a recognition of the Batak community about the marriage. In this study, the author focuses on the implementation of the process pasu-pasu raja (marriage performed only by the Bride, Family and Indigenous Elders) for couples who are pregnant out of wedlock in the Batak Toba indigenous community abroad in East Sidomulyo Subdistrict Marpoyan Damai Pekanbaru. It is known that the Batak Toba tribe still adheres to their customs, especially in terms of marriage. In terms of the implementation of marriage according to Batak Toba custom, there is a wide range of problems regarding the marriage of royal vases, so that it makes young couples who take the wrong step to carry out the marriage of royal vases in their overseas areas. Based on the description above, this research establishes the main problem, namely how to implement the process of pasu-pasu raja (marriage that is only carried out by the Bride, Family and Traditional Elders) for couples who are pregnant outside of wedlock in the Toba Batak indigenous people who are overseas in Sidomulyo Timur Village, Marpoyan Damai District, Pekanbaru City. and the consequences of the implementation of the pasu-pasu raja (marriage that is only performed by the Bride, Family and Traditional Elders) for couples who are pregnant outside of wedlock among the overseas Batak Toba indigenous people in Sidomulyo Timur Village, Marpoyan Damai District, Pekanbaru City. The method used in this study, when viewed from its type, is classified as legal observation research by means of a survey, which is a type of research that takes data directly at the place or location of the incident to obtain the required data by using a collection tool. data in the form of interviews. The nature of this research is descriptive analytic, namely the author tries to provide a complete, detailed, and clear description of a reality related to the implementation of the pasu-pasu raja (marriage that is only carried out by the Bride, Family and Traditional Elders) for couples who are pregnant outside of marriage. to the Toba Batak indigenous people who live in East Sidomulyo Village, Marpoyan Damai District, Pekanbaru City. From the results of the study, it is known that, in the Batak Toba Overseas indigenous people in the Sidomulyo Timur Village, Marpoyan Damai District, Pekanbaru City, whose kinship system is patrilineal using the form of exogamous marriage, it shows that the Batak cultural community upholds the value of customs in the marriage of the Toba Batak tribe. In addition, there is also the implementation of pasu-pasu raja (a marriage that is only carried out by the Bride, Family and Customary Elders) for young people who have made a mistake. In this marriage, the position of the wife and children is carried out based on the provisions of the existing Toba Batak customary law.
