Abstract

Sirri marriage is a marriage that is done secretly (secret), or know by other wordreferred to as legitimate marriage under the islamic shari’a, but is not carried out by themarriage registration at the marriage resgistrtion staff or notreported ti the affairs office localreligion in accordance with what is regulated in the marriage law number 1 of 1974 article 2paragraph (2) concerning marriage registration. There are two main problems in this study, namely : how to implement sirri marriagein the district of Kubu Babussalam Rokan Hilir and what are the factors that cause theimplementation of sirri marriage in Kubu Babussalam Rokan Hilir sub-district. This research method is viewed from its type, this research is classified intoobservational research by direct field survey to obtain information and data relating to theresearch or the author, while viewed from its nature this research is descriptive which meansthe research intended to provide a detailed description, clearly and systematic about thesubject matter of the research. Based on the research results of the author about the implementation of sirri in thesub-district of Kubu Babussalam Rokan Hilir camp is not much different from theimplementation of an official marriage consisting of a bride, bride,guardian, and twowitnesses, the state has the right to regulate this matter in a regulation it is clear to providelegal and order protection in people’s lives. Some suggestions for the creation of a legalcertainty for sirri marriages to immediately resgister their marriages so as to obtain theirrights as citizens, for the goverment and law enforcement officials to give more attention tosirri marriages so that there is no understanding of marriage laws and islamic law so that themasrriage rules can be known and understood by everyone to do a legal marriage that hasbeen regulated by the state.
