Abstract

Rahn's contract is to make goods as collateral for the possible receivables as payment of receivables, either in whole or in part, the owner's goods as collateral for debt that can be used as payment if the person who owes cannot pay off the debt. In the implementation of the rahn contract the occurrence of defaults on the customers of the Ahmad Yani branch of the Islamic sharia pawnshop, because the customer is unable to pay or forget to carry out his obligations. The main problem in this study was the implementation of the Rahn Agreement between the Customer and the PT Pegadaian Syariah Branch Ahmad Yani, Pekanbaru City. The main problem is then entered into several subproblems, namely: What are the obstacles faced by the Customer in carrying out Rahn Agreement on PT Pegadaian Syariah Branch Ahmad Yani City of Pekanbaru and How is the default dispute settlement at PT Pegadaian Syariah Ahmad Yani Branch, Pekanbaru City. This research is a type of field research (observation) or empirical legal research and its nature is descriptive analytical. This research will be conducted by interviewing branch leaders, employees of PT Pegadaian Syariah Branch Ahmad Yani Kota Pekanbaru and customers of the PT Pegadaian Syariah. This study uses a sociological legal approach, namely direct research on space. For data collection obtained from observation, interviews and questionnaires. Based on the results of these studies answered regarding the implementation of the rahn contract at PT Pegadaian Syariah Ahmad Yani Branch has not been effective because there are still customers who have problems in implementing the rahn contract, such as lack of detailing the existing products at PT Pegadaian Syariah Ahmad Yani Kota Branch Pekanbaru, due notice and regarding administrative costs that are determined based on the customer's loan amount. Meanwhile, the dispute settlement process of the rahn contract at PT Pegadaia Syariah Branch Ahmad Yani Kota Pekanbaru by calling, texting, writing to customers 3 (three times) and if there is no response from the customer then the efforts to be made by PT Pegadaian Syariah with how to make an auction of collateral (collateral) belonging to the customer.
