Abstract
Humans use forests for several needs, including; as a source of livelihood such as; plantations, industrial plantations, mining materials, recreational needs, and others. The progress of science and technology has made it easier for businesses to exploit forests, thus increasing activities in each sector. The development of mining and plantation techniques has increased the area of forest exploited illegally and not according to its designation. the author draws on a number of issues that the author considers important to discuss further. The problems that will be discussed in the next chapter are: 1. How to prove the crime of mastering, owning timber from forest products that are not equipped with a certificate of legality of forest products case number 115 / Pid.Sus / LH / 2017 / PN.Pbr? 2. How is the application of the law of criminal offense mastering, having timber of forest products that are not equipped with a certificate of legality of forest products case number 115 / Pid.Sus / LH / 2017 / PN.Pbr? The method used is Normative Legal Research, by way of case study research, namely how to study Case Decision No.115 / Pid.Sus / LH / 2017 / PN.Pbr and is equipped with legal rules and legal theories or legal data. and the nature of the writing of this thesis is descriptive or describes the facts with related theories, as outlined in this paper is the legal protection of forests and timber from forest products. From the results of this study, it can be seen, based on witness statements, expert witness testimony, proof of the letter filed in court, evidence of evidence and testimony from the defendant, that this crime has been carried out in an organized manner for approximately a year. By utilizing community needs derived from income cutting wood in the forest, then being handed over to the collection point of timber then paid for, as well as ignorance of the community about the status of the huta they cut down so as to strengthen the evidence that the timber products are clearly not valid forest products or obtained illegally.
