Abstract

Violation of the misuse of residence permits of foreigners in the Pekanbaru City area where the Head of the Immigration Immigration Division of Riau, namely Surya Pranata said that as of March 2018 as many as 27 foreign nationals were deported due to overstaying and not reporting whereabouts in Indonesia. Therefore, the important role of the immigration aspect in the state of life will be seen in the arrangement of entry or exit of people from and into the city of Pekanbaru, the issuance of foreign entry signs at the Immigration checkpoint, and the provision of immigration residence permits and supervision of foreigners during in the area of Pekanbaru City in terms of the existence and activities carried out by foreigners in accordance with the Visa or Immigration Stay Permit that they use in the Pekanbaru City area. The main problem of the research is the process of prosecuting foreigners who violate immigration law, and how to deal with foreigners who violate immigration law. The research method is observational research research that is by way of a survey or reviewing directly to the location of the study using a data collection tool that is interview. While the nature is descriptive, the writer tries to give a detailed description of the Process of Enforcement of Foreigners Who Violate Immigration Law. The results showed that the process of prosecuting foreigners who violated immigration law was still not running well in the supervision and enforcement of immigration even though there were rules governing it in accordance with Article 66 paragraph 2 and Article 75 paragraph 2 and 3 of Law Number 6 of 2011 Regarding Immigration, there are still many foreigners who violate residence permits.
