Abstract

The rise in criminal cases of sexual intercourse against children in Bengkalis Regency, especially the intercourse committed by fathers against their own biological children and the many obstacles that occur to carry out investigations prove that the protection and handling of children is still very minimal in Bengkalis Regency. The main problem in this research is how is the process of investigating the criminal act of sexual intercourse by the father against the biological child in the Bengkalis Police jurisdiction and anything in the process of investigating the criminal act of sexual intercourse by the father against the biological child. The research method used by researchers is a type of observational research method (observation research) through a survey method. As well as the nature of this research is descriptive, while the data collection tool in this study is through interviews with the pleasure of the investigation process and the obstacles in the process of investigating the criminal act of intercourse by the father against the biological child at the Bengkalis Police. The result of this research is that the process of investigating criminal acts of sexual intercourse by fathers against biological children is carried out in stages, making reports, conducting investigations, conducting Visum et Refertum (VeR), sending letters of notification of the commencement of investigations, conducting examination of witnesses, making coercive measures, title cases, Filing, Submission of Case Files to the Public Prosecutor, Handover of Suspects and Evidence. The investigation is carried out in accordance with what is mandated in the Criminal Procedure Code. And obstacles in the process of investigating the difficulty of obtaining information from victims of intercourse, the absence of witnesses who saw directly, Visum et Refertum (VeR) were late.
