Abstract

Actions against the law nowadays often occur in the community, one of the cases of illegal actions is cases that are accepted, accepted, tried and decided at Bangkinang District Court Number: 09 / Pdt.G / 2013 / PN / Bkn. The formulation of the problem in this study is how the lawsuit against the biological mother for an unlawful act of selling the price of her husband's inheritance at an unreasonable price in Civil Case Number. 09 / Pdt.G / 2013 / PN.Bkn and what is the consideration of the panel of judges in deciding the Civil case Number. 09 / Pdt.G / 2013 / PN.Bkn. The research method used in this research is normative legal research, namely research on legal principles, legal comparisons by reviewing civil case files number 09 / Pdt.G / 2013 / PN.Bkn and discussing them with reading material obtained from various sources. From the results of the research conducted by the author, it is known that the lawsuit against the biological mother for an illegal act of selling the price of her husband's inheritance at an unreasonable price in Civil Case No. 09 / Pdt.G / 2013 / PN.Bkn because the Plaintiff considered their mother's action, namely Hj. Zahara (Defendant I) was an act against the law because he sold a piece of land at an unreasonable price to Hj. Hemmiati (Defendant II) without the knowledge and permission of the Plaintiffs which was known and signed by the Head of the Mining District (Defendant III). The Plaintiffs apologize that the sale can be declared null and void. The consideration of the panel of judges in deciding the Civil case Number. 09 / Pdt.G / 2013 / PN.Bkn is not correct, because Defendant I has the right to his share of assets and Defendant I's act of selling part of the land which is part of it to Defendant II is an illegal act, the sale and purchase between Defendant I and Defendant II is lawful according to law.
