Abstract

Law enforcement for copyright infringement is faced with problems such as where pirates tend to make money to fulfill their livelihoods and most are carried out by retail traders whose welfare levels are low but on the one hand the government must be able to carry out law enforcement and protection of these copyrights. Not infrequently the practice of violations committed by hijackers is used as a means of livelihood for them, so that many depend on their work to sell films and songs of VCD (Video Compact Disc) and pirated (Digital Video Disc) DVDs. Based on the background of the problem that the author described above, the authors first set about Law Enforcement Against Law No. 19 of 2002 concerning Copyright by Pekanbaru City Resort Police Against Copyright Infringement by Entrepreneurs of Pirated VCD, DVD in Pekanbaru City in Case Number 188 / Pid.Sus / 2014 / PT.PBR and Constraints in Law Enforcement of Pekanbaru City Resort Police Against Violations Law No. 19 of 2002 concerning Copyright by Entrepreneurs of Pirated VCD, DVD in Pekanbaru City in Case Number 188 / Pid.Sus / 2014 / PT.PBR. This writing, when viewed from the type of research, uses observational research methods, namely by survey, where the author directly locates the study to obtain the data needed by using a data collection tool in the form of interviews and questionnaires. The nature of this study is descriptive, which means that this study provides a clear and detailed description. From the results of research and discussion that law enforcement against Law No. 19 of 2002 concerning Copyright by Pekanbaru City Resort Police Against Copyright Infringement By Entrepreneurs of Pirated VCD, DVD Rentals in Pekanbaru City In Case Number 188 / Pid.Sus / 2014 / PT.PBR is Law Enforcement of Copyright Protection Against VCDs and DVDs In the city of Pekanbaru, which is carried out by means of law enforcement that must be the main foundation in eradicating piracy against pirated VCDs and DVDs. This law enforcement is an effort made to make law, both in a narrow legal sense and in a broad material sense, as a guideline for behavior in every legal action, both by the legal subjects concerned and by law enforcement officials who are officially given the duty and authority of the Law to guarantee the functioning Legal norms that apply in people's lives and state. Constraints in Law Enforcement of Pekanbaru City Resort Police Against Violations Law No. 19 of 2002 concerning Copyright by Entrepreneurs of Pirated VCD, DVD in Pekanbaru City in Case Number 188 / Pid.Sus / 2014 / PT.PBR that the development of piracy cannot be separated from the role of the community itself, where the community as consumers not only feel they are not guilty of buying pirated products, but often feel benefited by the very cheap prices of pirated VCD and DVD tapes, for which law enforcement carried out by the Police will not run well, if the community does not support the police's efforts to eradicate crime this copyright infringement reaches the roots.
