Abstract

Rights to freedom of religion and belief is one of the rights in UDHR in 1948 and in any other regulations about human rights in Indonesia. Article 18 said rights to freedom is a rights that has to be fulfilled in every situation. As a rights that has to be fulfilled, rights of religion has to apply in universal and without discrimination. However, because there are lot of diversity and characteristics in society, religion or ideologic, there must be a conflict from one to another, as lack of tolerance and respect to other religion. The problems in this thesis are: How is the protection to rights of freedom and belief in Indonesia according to UDHR and How is the role of Komnas HAM in protection to rights of freedom and belief in Indonesia according to UDHR in resolving conflicts in people and community that related to rights of relogion. This thesis is using normative study method and have descriptive research. The informations in this thesis are secondary which is involving primary, secondary, and tertiary material. This thesis is doctrinal research The results in this research shows, nation guarantees the rights of freedom and belief for the people, and not interferee any aspect in a religion. Also, at the same time nation have to protect all of the people and give the secure for all the people. Komnas HAM have unit named KBB Desk. This unit have a special task to handle rights to freedom of religion and belief cases. This unit supports Komnas HAM at responding and handling rights to freedom of religion and belief cases which have the good results. The proper ways to reducing these problems are by respecting each other and having big tolerance. Goverment have to has a represive action if there are any cases or problems about religions and belief differences.
