Abstract

The customary law system has been adopted and enforced in Bandar Petalangan District, Pelelawan Regency. It is guaranteed by the 1945 Constitution that the State recognizes and respects the unity of customary law communities and their traditional rights as long as they are alive and in accordance with community development and the principles of the Unitary Stat. Republic of Indonesia. The goal of this study is to determine how the process and application of customary law system in the District of Bandar Petalangan in resolving criminal cases of honey theft. This type of research is a type of descriptive research with a qualitative research approach. The location of the research was in Bandar Petalangan District, Pelelawan Regency. In this study, the key informants were the perpetrators of honey theft, traditional leaders, village heads and community leaders. The data needed in this study were primary and secondary data sources. Data collection techniques that are usually used for self -identification surveys consist of two methods including interviews, observations and documentation. This research data analysis technique used descriptive analysis of qualitative data The results of this study showed that the stage of the customary law process conducted on the notification to parents and families of the case of theft of honey bees in the district of Bandar Petalangan Pelelawan regency followed the customary court process and received the sanctions given. The customary leader will call the parents or family to consult and through the customary process, sanctions will be imposed on the perpetrators in order to deter them from committing crimes. After the perpetrator serves his sentence, he will be returned to the community as a person who is clean from crime and able and accepted by the community to live socially in the area.
