Abstract

In the Annual Report of the Religious court of class I.B Bangkinang it was reported that during 2017 the percentage of successful mediation was only 4.12%. The small percentage of success of the Religious court of class I.B Bangkinang Judge in mediating the parties to the litigation, this is the background of the writer to examine and discuss this research, by limiting it to the communication pattern of the Religious court of class I.B Bangkinang Judge in the mediation process in the divorce case and the Court Judge constraints. Class I.B Religion in the process of mediation in divorce cases. With qualitative research and to obtain data this research is done through Field Research (field research) and Library Research (library research). By using observation, interview and documentation data collection techniques, it is known that the Communication Pattern of the I.B Class Bangkinang Court Judges in the mediation process in divorce cases is a circular communication pattern, which the parties are equally obliged to convey the problems faced while the mediating judge is obliged to listen and provide direction and guidance to the parties so that there are no regrets when a decision has been taken. In this mediation process circulating communication patterns occur, there is feedback in the mediation process. The obstacle of the I.B Class Bangkinang Religious Court Judge in the mediation process in divorce cases is the strong desire of the parties to divorce, the parties or one of the parties has another partner namely WIL or PIL, a unanimous determination from the wife, a prolonged and very complicated conflict has occurred. the existence of bad intentions from the parties, the absence of one party, psychological factors, the shame to give in, the divorce has occurred outside the court hearing and the object of the matter is unseen.
