Abstract

The development of the economic activities of the people, makes the needs of the community more diverse, such as in financing contract activities that have developed, including in the form of take over financing (debt transfer), including through the Kafalah bil Ujrah financing contract. This research is based on the condition that in general the financing of Kafalah bil Ujrah carried out by BMT Darussalam FAI UIR is in order to help students who are in difficulty paying tuition fees and credits. This study wants to see how the implementation of the Kafalah bil Ujrah financing contract for students at the BMT Darussalam Islamic Religion Faculty, Riau Islamic University, Pekanbaru in the perspective of Islamic Economics. This research is included in the type of field research (field research) and literature review (literature review). The technique of collecting data through interviews and online questionnaires. The data analysis technique is based on percentage analysis and inductive analysis through a qualitative descriptive analysis approach. The results of this study indicate that first, the implementation of the Kafalah bil Ujrah financing contract for students at BMT Darussalam FAI UIR Pekanbaru has been going well and should be based on an assessment of the level of implementation of research variables, namely the level of implementation or implementation of the Kafalah bil Ujrah financing contract and the level of implementation or implementation. harmonious and legal terms of financing Kafalah bil Ujrah. Second, the implementation of the Kafalah bil Ujrah financing contract for students at BMT Darussalam FAI UIR Pekanbaru from the perspective of Sharia Economics, especially from the perspective of contemporary scholars and scholars of fiqh, is permissible (mubah) or in accordance with Sharia Economics. Third, the implementation of the Kafalah bil Ujrah financing contract for students at BMT Darussalam FAI UIR Pekanbaru from the perspective of Sharia Economics, especially from the perspective of the MUI DSN Fatwa No. 11 of 2000 concerning Kafalah and Fatwa DSN MUI No. 57 of 2007 concerning L/C with Kafalah bil Ujrah is permissible (mubah) or in accordance with Sharia Economics.
