Abstract
Human Rights teaches the principle of equality and human freedom so that there should be no discrimination, exploitation, and violence against human beings in any form towards basic human freedom including the right to freedom of religion. Article 18 The Universal Declaration of Human Rights 1948 states that everyone has the right to freedom of thought, conscience and religion in this matter including the freedom to change religion over belief. But in Western European countries such as France and Germany and in our own country, Indonesia, the issue of religious freedom is still the topic of the most widely discussed society. Especially with the cases of religious violations such as the case of prohibiting the use of religious symbols in Western Europe and the bombing of a number of places of worship in Indonesia, violating human rights concerned with freedom of religion which has been regulated in the Universal Declaration of Law and Government Regulations -Estrictions in Indonesia. The problem of this study, namely regarding the comparison of religious freedom between Indonesia and Europe and the guarantee of religious freedom in terms of the Universal Declaration of Human Rights 1948 and its implementation. This study uses the Normative Law research method. Where the author conducted a literature study by examining primary, secondary, and tertiary data in the form of legislation covered by the Universal Declaration of Human Rights 1948, reading materials, books, literature, expert opinions related to the subject matter of this research, dictionaries, mass media, and the internet. Data analysis, which is after the author obtains the necessary data from primary, secondary, and tertiary legal materials, then the data is summarized and arranged in the form of systematic sentences. From the results of this study, it can be concluded that the comparison of religious freedom between Indonesia and Europe is very opposite. In Europe, Muslims as religious minorities often receive discrimination from the majority religious community there and the use of religious symbols such as hijab is prohibited, while in Indonesia, it is the Christians, Hindus and Buddhists who often get discriminatory treatment from majority religious Muslims. In fact, guarantees of religious freedom are very clearly stipulated in the International Declaration and Convention and the rules of legislation in Indonesia. But in practice there is still discrimination that is received by minority religious people in several countries.
