Abstract
Customary law is a law that lives and develops in society. However, if the customary law is not contradictory to the interests of national law then it is deemed to be valid, however, if the customary law is deemed to be contrary to positive law or national law, then the provisions of the written law shall prevail. However, in one area of the nagari in Minangkabau there is provided a place to confine the caught man to immoral. The people call the place Adat Jail. This prison is built by the community leaders. In this study the authors use the type of qualitative research. As for the key informen and informen, the key informen is the guardian nagari tigo jangko, chairman of KAN, perpetrators of idolatry, and family actors. While the informant is the police, youth chairman, and society. In the interview result the authors can conclude that customary prisons can prevent the immoral act in Nagari Tigo statue. Based on Restotative Justice. Restorative justice is a form of justice centered on the needs of victims, perpetrators of crime, and society.
