Abstract

In principle, the Regional Government is not authorized to regulate religion. Religion is the central authority. Several regencies / cities in Riau province make regulations, especially Riau Province which has vision and mission to make Riau region as center of culture, education and economy, based on Malay culture and religion. This is certainly a problematic in the Central Government and Local Government in applying the Regional Regulation on Zakah. The central issue of How is the Political Decentralization in the Formation of Regional Regulations in the Field of Religion. What are the constraints in the Formation of Regional Regulations in the Field of Religion. Research Methods are observational research with respondents Riau Governor, Kakanwil Depag Riau, Chairman of MUI Riau, and Baznas Riau Province. The results of research and discussion of the Politics of Decentralization in the Formation of Regional Regulations in the Province of Riau: (1) Program budget by the Government of Riau Province: Assistance in improving religious understanding in the practice of religious values, obedience and obedience to religious values such as priest fee , ghorim, khotib, such thing is a policy of decentralization in the field of religion run by the Government of Riau Province. Implementation of Musabaqah Tilawatil Qur'an (MTQ) since from the process of coaching to its form in improving the ability to understand the meaning contained in the Qur'an is measured by the implementation of Musabaqah Tilawatil Qur'an in general and tiered, it is set forth in the mandate of the Joint Decree (SKB) the Minister of Home Affairs and the Minister of Religious Affairs to the development agencies of Tilawatil Qur'an and Local Government each budget year is obliged to allocate budget for Tilawatil Qur'an. Implementation of Hajj, it can be seen clearly that the Government helps the community in the form of domestic travel costs. (2) Regulation of Regional Regulation Policy in Religion field, the issuance of this Regulation concerning religion aims to reinforce the implementation of the Regulation itself and does not make the Rule established by Local Government to become another new regulation also determined by the Central Government. Constraints in the Formation of Regional Regulations in the Field of Religion (1) The full authority of the People's Legislative Assembly, (2) The planning and drafting phase is one of the important factors; therefore, the establishment of the Legislation should start from the planning. Arranged in a planned, integrated and systematic manner, supported by definite methods and standards that bind all institutions authorized to enact legislation, and (3) the existence of sharia law is still controversial.
