Abstract

Passenger baggage issues are the most crucial issue at the moment. Under the transport law, the carrier obligations shall, among other things, transport passengers and / or goods safely, intact and safely to the destination, provide good service, compensate passengers in the event of a loss to the passenger, dispatch of passengers according to a predetermined schedule and etc. Whereas the liability of the passenger is to pay the transportation fee of the specified amount, to safeguard the goods under its control, to report the types of goods brought, especially the goods that are categorized as dangerous, to comply with the provisions stipulated by the carrier concerning the carriage. Theoretically, the transport agreement is an engagement whereby one party undertakes to safely carry people or goods from one place to another while the other party, undertakes to pay the fare. The main problem of this research is the Responsibility of PT. Lion Air Against Loss and Damage of Passenger Baggage Luggage In Flight To Sultan Syarif Kasim II Airport and Legal Settlement of Airlines By Airlines PT. Lion Air Against the Loss and Damage of Baggage Luggage Passenger In Flight Towards Sultan Syarif Kasim II Airport This type of research is an observational reseach by way of survey, that is research which take direct data from population / respondent by conducting interview and questionnaire as data collecting tool, then from data taken done processing so that obtained by conclusion with inductive method. Meanwhile, if viewed from its nature, this research is descriptive research that explains in the form of clear and detailed sentences about Legal Certainty of Responsibility Against the Loss and Damage of Baggage Luggage Passengers In Flight To Sultan Syarif Airport Kasim II (Study On Airline PT. Lion Air). Corporate Responsibility PT. Lion Air Against the Loss and Damage of Passenger Baggage In Flight to Sultan Syarif Kasim II Airport that based on the responsibility of presumption of guilty where according to this concept the air carrier is found guilty and will pay compensation for the lost of checked baggage. In practice, however, many passengers who lost their luggage felt that their passenger rights were not properly met by the airline company at Sultan Syarif Kasim II Airport. Legal Settlement of Airlines By Airlines PT. Lion Air Against Loss and Damage of Passenger Baggage In Flight To Sultan Syarif Kasim II Airport can be reached in two ways including: a. Through non litigation and b. With litigation. Non litigation efforts shall be made by making a direct claim with the air carrier, and then followed up by searching for lost luggage items or replacing the goods in accordance with applicable laws and regulations. It may also be submitted to the Consumer Dispute Settlement Agency. The litigation effort is made by filing a civil suit to the District Court. So far, the airlines at Sultan Syarif Kasim II Airport have never been sued by passengers, this is because passengers regard it as a time-consuming process.
