Abstract
Marriage annulment is a highly sensitive matter and carries significant consequences, both from a religious, state legal, and socio-cultural perspective. Therefore, it must be positioned in its proper place to soothe the community and calm the soul, and is usually carried out without raising doubts in society. Marriage annulment is a legal action that declares a marriage invalid due to the failure to fulfill the requirements of marriage as stipulated by applicable laws and regulations. This annulment is carried out through a court decision at the request of the entitled parties, on the grounds of legal defects since the marriage took place, such as the existence of a prohibition on marriage, the incompetence of the married parties, or the failure to fulfill administrative and substantive requirements. With the annulment of a marriage, the marriage is considered never to have existed legally, although it still has certain legal consequences, especially for children born and parties who acted in good faith. The research questions in this thesis are: first, what are the factors causing marriage annulment in the Pekanbaru Religious Court? Second, what are the judges' considerations regarding (Decision Number 1/Pdt.G/2021/PA.Pbr). The research method used to address this research problem is a normative legal research method, which focuses on legal studies, norms, and other legal provisions, as well as examining laws and court decisions in accordance with Decision Number 1/Pdt.G/2021/PA.Pbr in the Pekanbaru Religious Court. The results of this thesis research show that the first factor causing the cancellation of a marriage is because of conditions that are not fulfilled in the marriage contract or because of other things that come up later that cancel the continuation of the marriage. Second the judge's considerations in deciding the marriage annulment case at the Pekanbaru religious court (decision number 1/Pdt.G/2021/PA.Pbr) The judge granted the Petitioner's request with a Verstek Decision, where a verstek decision is a decision handed down by the court in a civil case if the defendant is not present without a valid reason at the first hearing.
