Abstract

This research examines the strengthening of the legislative function of the Regional Representative Council of the Republic of Indonesia (DPD RI) in a bicameral system through a comparative study with the Australian Senate. The establishment of the DPD RI post-amendment of the 1945 Constitution was intended to strengthen regional representation and create a checks and balances mechanism in the national legislative process. However, in practice, the legislative authority of the DPD RI remains very limited compared to the DPR RI, categorizing Indonesia's bicameral system as soft bicameralism. This condition contrasts sharply with the Australian Senate, which implements strong bicameralism with legislative powers nearly equal to the House of Representatives. The research questions are: (1) How can the legislative function of the DPD RI be strengthened in a bicameral system compared to the Australian Senate? (2) What is the ideal bicameral system design based on the comparison between the DPD RI and the Australian Senate? This research constitutes normative legal research with a comparative approach. Data sources consist of primary, secondary, and tertiary legal materials. Data analysis was conducted qualitatively using deductive conclusion methods. The research findings indicate that the DPD RI experiences structural limitations stemming from the constitutional design of Article 22D of the 1945 Constitution, whereas the Australian Senate possesses equal power based on Article 53 of the Australian Constitution. The ideal bicameral system for Indonesia is a moderate-strong bicameralism model that is symmetrical in territorial matters but asymmetrical in non-territorial matters, with strengthening through the fifth amendment of the 1945 Constitution, revision of the MD3 Law, establishment of a Joint Committee, and strengthening the institutional capacity of the DPD RI.
