Abstract

This study examines the prohibition of same-clan marriage within the Minangkabau customary law community in Kenegerian Pangean, KuantanSingingi Regency. The beckground of this research is the continued occurrence of same-clan marriages within the community, despite the fact that, under the Minangkabau matrilineal kinship system, such marriages are strictly probihibited as they contradict prevailing customany norms and the principle of exogamy The research addresses several issues: how same-clan marriages are practiced within the Minangkabau customany community of Kenegerian Pangean, what customary sanctions are imposed on the perpetrators, and what factors contribute to the occurance of such marriages. This study aims to identify and analyze the implementation of same-clan marriages, the forms of customary sanction applied, and the underlying factors causing these practices. The method used in this research in an empirical sociological legal approach with field research. Data were collected through interviews and documentation involving ninik mamak (traditional leaders), individuals involved in same-clan marriages, and their parents. The data were analyzed qualitatively to provide a systematic description and to address the formulated research problems. The results of the study indicate that the implementation of same-clan marriage whitin the Minangkabau customary marriage process. In practice, certain customary elements that should be fulfilled are not carried out properly. One form of this nonconformity is reflected in the absence of the Ninik Mamak (traditional elders) from the wedding ceremony as a form of customary rejection of the same-clan marriage. The sanctions imposed on individuals who engage in same-clan marriage include customary reprimands, customary fines such as being required to provide one white buffalo, and social sanctions in the form of expulsion from Kenegerian Pangean. Furthermore, the fakcors contributing to the occurrence of same-clan marriage whitin the Minangkabau customary community in Kenegerian Pangean include a lack of understanding of customary law and the influence of social developmens whitin the community. This prohibition of sameclan marriage aims to maintain order, harmony, and the preservation of Minangkabau customary values.
