Abstract

Traffic accidents are a frequent problem due to the increasing density of road users in Indonesia. Traffic accidents are unlawful acts that constitute a criminal offense, as regulated in Law Number 22 of 2009 concerning the provisions of the Traffic and Road Transportation Law. Proceedings must be processed legally in accordance with the criminal justice system. In this case, the Kuantan Singingi Police Resort, in particular, uses the principle of restorative justice to address and resolve traffic crimes within its jurisdiction. The main questions in this study are: how the principle of restorative justice is applied to traffic crimes within the jurisdiction of the Kuantan Singingi Police Resort and what obstacles are encountered in resolving traffic crime cases using restorative justice principles within the jurisdiction of the Kuantan Singingi Police Resort. This study uses an empirical legal research method. The data used are primary data obtained directly through interviews and secondary data obtained from primary legal materials. The results of this study indicate that the application of the Restorative Justice principle to traffic crimes in the jurisdiction of the Kuantan Singingi Police Resort refers to the Republic of Indonesia Police Regulation Number 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice. The implementation of this principle is in accordance with existing regulations, one of which is that all parties involved, such as traffic accident perpetrators, victims, and families of traffic accident victims, agree to reconcile through deliberation to resolve traffic accident cases and this agreement is stated in an agreement signed by the parties. Obstacles in the application of the Restorative Justice principle to traffic crimes in the jurisdiction of the Kuantan Singingi Police Resort do not have many obstacles faced by the Traffic Police Unit because basically the implementation of the Restorative Justice principle occurs with the agreement of each of the two parties.
