Abstract
The palm oil industry has a vital role in the Indonesian economy, including in Pelalawan Regency, Riau, which is known as one of the largest plantation centers. Despite the high economic contribution, this sector faces a serious challenge in the form of the theft of Fresh Fruit Bunches (TBS) that continues to occur massively. Various countermeasures that have been implemented by the Pelalawan Police have not been able to completely dampen this criminal act, indicating that there is an adaptive and structured crime pattern that has succeeded in exploiting loopholes in the law enforcement and security system. The main problem raised in this research is about the effectiveness of the efforts applied by the Pelalawan Police in tackling the theft of palm oil fruit reviewed from a criminological perspective, as well as how the pattern or modus operandi of the crime adapts to changes in commodity prices and the legal limits of minor crimes (Tipiring) based on the Supreme Court Regulation Number 2 of 2012. This research aims to analyze the causative factors, the form of modus operandi, and formulate strategic recommendations to increase the deterrence effect of prosecution. The research method used is a qualitative approach with a type of analytical descriptive research, which focuses on criminological studies in the legal area of the Pelalawan Police. The data was collected through direct field observations, documentation studies, and in-depth interviews with law enforcement officers from the Criminal Investigation Unit (Sat Reskrim) of the Pelalawan Police and the Pangkalan Kuras Police, as well as interviews with theft perpetrators who have been arrested to obtain primary data on their crime adaptation patterns. The results of this study concluded that the perpetrators of the theft of TBS palm oil showed an adaptive criminological tendency, where they deliberately controlled the volume of theft to keep the value of the loss below the Tipping limit (Rp2,500,000) in order to avoid heavier formal judicial proceedings. The existing countermeasures are still predominantly reactive. It is recommended that the Pelalawan Police adopt a cumulative enforcement strategy that combines the snare of the Criminal Code with sectoral laws, as well as advocating a review of the limits of the Perma 2/2012 Tipiring to consider the element of recidivism and the frequency of crime.
