Abstract

The development of information technology has driven the government to digitize various sectors of public services, including the land administration system. The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) responded to this transformation by implementing the Electronic Mortgage System (Hak Tanggungan Elektronik or HT-el), as regulated in Ministerial Regulation of ATR/BPN No. 9 of 2019 in conjunction with Ministerial Regulation No. 5 of 2020 on Integrated Electronic Mortgage Services. This system aims to create a more efficient, transparent, and accountable land service process. However, the reality is that in the Pelalawan Office there are still many failures regarding electronic mortage rights. This study aims to examine the implementation and obstacles in the registration of electronic mortgages at the Land Office of Pelalawan Regency, as well as to analyze the effectiveness of its application as a land security instrument. The research adopts an empirical method with a descriptive qualitative approach, collecting primary data through interviews with key respondents namely the Head of the Land Office, Land Deed Officials (PPAT), and banking representatives as well as secondary data from legislation and relevant legal literature. The results indicate that the implementation of electronic mortgage registration at the Pelalawan Land Office has generally proceeded well and has shown significant decline over the years. Data from 2020 to 2024 demonstrate an increasing trend in applications with a low rate of successful issuances. In 2020, there were 1.988 applications with 1.984 certificates successfully issued, while in 2024, applications succesfull to 910 with 800 certificates issued. Nevertheless, several challenges remain, including system errors, delays in document uploads, and limited user capacity in operating electronic-based applications. Overall, the implementation of the HT-el system in Pelalawan Regency is considered effective, as it has accelerated service processes, enhanced legal certainty, and reduced the potential for maladministration. However, further improvement in human resource quality and information technology infrastructure readiness is still required to achieve optimal service effectiveness.
