Abstract

In accordance with the developments in the legal landscape influenced by globalization, Mahkamah Agung and subordinate judicial institutions have adapted to these changes. Over time, and to address the contemporary need for optimal utilization of technology within the courtroom, the Chief Justice of Mahkamah Agung amended Regulation Number 3 of 2018 by implementing E-Litigation through Mahkamah Agung Regulation (PERMA) Number 1 of 2019 concerning the Administration of Cases and Trials in Court Electronically. This regulation was subsequently refined in 2022 through Mahkamah Agung Regulation (PERMA) Number 7 of 2022, which pertains to amendments to PERMA Number 1 of 2019 regarding the administration of cases and trials electronically. The initial amendment was essential because PERMA Number 3 of 2018 exclusively governed case administration and did not extend to the trial stage. E-Litigation is anticipated not only to enhance efficiency in trial management but also to promote a higher degree of transparency. This research addresses two issues: the implementation of PERMA Number 7 of 2022 concerning registered letter summons at Pengadilan Agama Dumai, and the challenges faced in executing PERMA Number 7 of 2022 regarding registered letter summons at Pengadilan Agama Dumai. This study employs an observational research methodology, also known as sociological legal research. Sociological legal research aims to examine the interconnectedness between law and society, particularly noting the disparity between das sollen (what ought to be) and das sein (what is). The nature of this research is descriptive-analytical, involving the description of the condition of the research subject or object, such as individuals, institutions, symptoms, or social phenomena. The delivery of registered letters via PT Pos Indonesia (Persero) employs three types of products: (1) Pos Sameday: A registered letter delivery service with a standard handover time on the same day within the local city network, (2) Pos Nextday: A registered letter delivery service with a maximum handover time of D+1 within a limited national network, (3) Pos Reguler: A registered letter delivery service with a maximum handover time of D+11 within a limited national network. Electronic summons can also be delivered to parties residing outside the jurisdiction of the court presiding over the case. These summons are transmitted to the respective parties through their electronic domicile, with a copy also sent to the court in the residence location of the respective parties. PT Pos Indonesia, in its delivery of registered letters, must establish qualifications for its personnel. Staff involved in delivering registered letters must also be familiar with the regulations imposed by the Supreme Court of the Republic of Indonesia to ensure that the organizational, mechanical, or social systems operate in accordance with the rules established by policymakers. This is intended to facilitate the realization of the principles of swift justice and cost-efficiency. Furthermore, the local court is also responsible for conducting socialization programs regarding civil procedural law rules concerning the validity and appropriateness of summons and notifications of court decisions and rulings to field officers at PT Pos Indonesia (Persero), in addition to official training sessions or socialization forums.
