Abstract
This study examines the legal protection provided to car rental business owners in rental agreements that suffer losses under Law Number 8 of 1999 concerning Consumer Protection, using a case study of CV. Fadlan Utama Mandiri, Pekanbaru City. The purpose of this study is to determine the form of legal protection provided to car rental business owners, the factors causing losses, and the dispute resolution efforts that can be undertaken in accordance with statutory provisions. The research method used is a juridical method with a statutory approach and field studies, supplemented by direct interviews with business owners and collection of rental agreement documents. The research problem formulation in this study is as follows: First, What is the Form of Legal Protection for Car Rental Business Owners in Rental Agreements that Suffer Losses under Law Number 8 of 1999 concerning Consumer Protection at CV. Fadlan Utama Mandiri, Pekanbaru City? Second, What are the Obstacles in Providing Legal Protection to Car Rental Business Owners in Rental Agreements that Suffer Losses under Law Number 8 of 1999 concerning Consumer Protection at CV. Fadlan Utama Mandiri, Pekanbaru City? The research results indicate that the car rental business owner, CV. Fadlan Utama Mandiri, holds the status of a business actor under Article 1 number 3 of the Consumer Protection Law and is entitled to legal protection as stipulated in Article 6 of the Consumer Protection Law. Available forms of protection include preventive protection through clear rental agreement clauses and tenant identity verification, as well as repressive protection through dispute resolution through the Consumer Dispute Resolution Agency (BPSK) and the courts. The main obstacles faced are the low legal awareness of business actors in utilizing the protection mechanisms stipulated in the Consumer Protection Law, as well as the lack of written evidence that could strengthen the business owner's legal position in the event of a dispute. This research recommends improving the quality and completeness of rental agreement clauses, maximizing the use of consumer dispute resolution procedures, and increasing legal awareness of business actors through training and outreach on the Consumer Protection Law. These measures can minimize losses due to bad faith tenants and make legal protection for car rental business owners more effective.
