Abstract

The deconstruction of Islamic legal thought has gained increasing relevance by facilitating alternative interpretations of inheritance law applicable to multireligious families. However, this context has largely been overlooked in previous studies. In addition to addressing these gaps, this study focuses on explaining the significance of deconstructing Islamic thought in responding to legal dynamics and the complexity of heirs’ rights in multireligious family contexts. This study adopts a qualitative descriptive design based on normative texts, as this approach facilitates an in-depth conceptual and interpretative analysis of Islamic legal thought. The findings indicate that the deconstruction of Islamic inheritance law in Indonesia reflects a transformative shift toward a more inclusive, contextual, and substantively just framework in response to evolving social realities. This deconstruction marks a fundamental transition from a predominantly textual approach toward a more adaptive understanding of social conditions, particularly in addressing the increasing complexity of interreligious family relationships. The significance of this study lies in its contribution to religious studies, particularly Islamic legal thought, by reframing law not merely as a normative doctrine but as a dynamic and socially embedded practice.
