Abstract

Pangolins, classified under Appendix I of CITES, are among the world's most endangered species, receiving the highest level of international protection. Despite this, the illegal trade of pangolins remains rampant in Indonesia, threatening their survival. The purpose of this study was to determine the legality of illegal pangolin trade according to Presidential Decree No. 43 of 1978 and to determine how the implementation and legal protection of pangolin trade is regulated by CITES. This study uses a normative judicial method. The problem of the study are (1) the legality of pangolin trade according to Presidential Decree No. 43 of 1978 regarding pangolin control, and (2) the implementation and legal protection of pangolin trade regulated by CITES. The legal materials in this study are primary legal materials including CITES, The Act of the Republic of Indonesia No.5 of 1990 concerning conservation of living resources and their ecosystems, Government Regulation No. 8 of 1999, Government Regulation No. 7 of 1999, and Presidential Decree No. 43 of 1978, secondary legal materials include the results of thesis research, scientific journals that have been accredited and published by educational institutions and newspapers, and tertiary legal materials such as dictionaries. The results of this study indicate that CITES and government legal protection have not been effective in providing protection to pangolins. The suggestions from this study are the need to increase public education and awareness, increase legal protection, improve legal policies, and increase the capacity of law enforcement against illegal pangolin trade.
