Abstract

Gambling is a criminal act that negatively impacts social order and is prohibited under Indonesian criminal law. In the digital era, gambling has become increasingly accessible through online platforms, making it more difficult to supervise, leading to a rise in the number of offenders and adverse effects on society, such as financial loss, addiction, and psychological disturbances. The formulation of the problem in this study is how is the process of proving gambling in public places in case number 7/Pid.B/PN Pdg and how is the legal consideration of the panel of judges in deciding case number 7/Pid.B/PN Pdg. This research uses normative method, where data were obtained through court decision document studies and related legal literature. Data collection was conducted through library research, and data analysis was carried out using qualitative descriptive-analytical methods. The results of the study show that the process of proving the crime in this case has met the minimum requirements for evidence in criminal procedural law, which is based on witness testimony, the defendant’s confession, and valid physical evidence. However, the evidence was not fully optimized due to the lack of digital evidence analysis and the absence of digital forensic experts in the trial. The judges’ legal considerations in delivering the verdict were in accordance with the provisions of the Criminal Code and Criminal Procedure Code, but the sentence imposed was relatively light and failed to provide a strong deterrent effect. Furthermore, the judges did not develop the case to trace the online gambling organizers.
