Abstract

With the increasing number of criminal acts in the field of Electronic Transaction Information related to elements of defamation or insults through social media which are increasing in the jurisdiction of the Riau Police, especially Sub- Directorate 5 of the Riau Police Criminal Investigation Unit, law enforcement is needed against perpetrators of insults and defamation through social media which is very optimal in an effort to overcome the increase in these cases. The main problem in this study is How is the Law Enforcement Against Perpetrators of Criminal Acts of Defamation in Sub-Directorate 5 of the Riau Police Criminal Investigation Unit, and What are the Obstacles in Law Enforcement Against Perpetrators of Criminal Acts of Defamation in Sub- Directorate 5 of the Riau Police Criminal Investigation Unit. The research method used for this study is Sociological Legal Research. Sociological Legal Research in this paper discusses the application of positive law. From the results of this study, it can be concluded that namely Law Enforcement Against Criminal Acts of Defamation in Sub-Directorate 5 of the Riau Police Criminal Investigation Unit that based on the provisions stipulated in the Criminal Code (KUHP) and the Electronic Information and Transactions Law (UU ITE), especially in handling defamation committed through electronic media. The application of articles 310 and 311 of the Criminal Code, as well as article 27 paragraph (3) of the ITE Law, is the main legal basis for prosecuting the perpetrators. The process of handling criminal acts of defamation in Sub- Directorate 5 of the Riau Police Criminal Investigation Unit starts from reporting the victim, investigation, inquiry, to the trial stage. Each stage is carried out professionally and procedurally in accordance with applicable regulations, although sometimes there are obstacles, such as difficulties in collecting electronic evidence and ensuring the conformity of criminal elements. Obstacles in Law Enforcement Against Criminal Acts of Defamation in Sub-Directorate 5 of the Riau Police Criminal Investigation Unit that technological developments and the rise of anonymity in cyberspace are major challenges. In addition, the lack of strong evidence often hampers the process of proof in defamation cases. Limited human resources, especially those with special expertise in digital forensics. In addition, inadequate legal regulations, long bureaucracy, and lack of understanding between institutions worsen the situation.
