Abstract
Car rental activities have become a common practice among the community, especially in Pekanbaru City. To ensure this process runs smoothly, a written agreement between the renter and the car rental owner is necessary. This agreement serves to provide legal certainty and protect the rights and obligations of both parties. Essentially, every agreement made must be carried out in good faith and with full responsibility. However, in practice, issues often arise when renters violate the terms of the agreed contract. Such violations, known as breaches of contract, can cause losses to car rental owners and disrupt the smooth operation of the business. The research problems in this study are as follows: first, how is the implementation of car rental agreements at CV. Dago Rental in Pekanbaru City, and second, what obstacles occur in the implementation of car rental agreements at CV. Dago Rental in Pekanbaru City. The research method used in this study is the type of sociological or empirical law, namely research conducted by looking directly at the field, with the main data sourced from observations and interviews. The research find of car rental agreements at CV. Dago Rental, Pekanbaru City, is conducted in writing to ensure clarity and legal certainty. The rental procedure requires renters to submit valid identification documents, such as a Driver’s License and Identity Card (KTP), and to complete a rental agreement form along with other administrative requirements. However, in practice, the implementation does not fully comply with Articles 1560 of the Indonesian Civil Code (KUHPerdata), as breaches of contract frequently occur. These include renters failing to meet their rights and obligations as agreed in the contract, such as vehicle body damage and major accidents.Obstacles in the implementation of car rental agreements faced by CV. Dago Rental in Pekanbaru City, namely: 1). Tenants who have the character of avoiding and being dishonest about damage that causes losses, 2). Tenants who are unable to pay compensation for car damage and delay payment, 3). No special guarantee is submitted.
