Abstract

Providing car rental services for rent to renters is an increasingly popular investment and business opportunity for people who want to rent a car, which is very strategically located. Situations like this require the provision of car rental services made by Elsa Motor. Because renting a car can benefit both the rental owner and the renter, car rental agreements are often entered into by the parties. After the parties entering into the agreement, namely the renter and the rental owner, reach an agreement, the car rental agreement comes into effect. The practice of car rental agreements that occur on Jalan HR. Soebrantas, the results of a survey that the author conducted on car rental owners and car renters by conducting interviews, generally use verbal agreements so that they cause many problems for both parties, lack of public understanding and lack of knowledge of the current legal regulations are one of the factors. The problems in this research are (1) How is the implementation of car rental agreements between business actors and consumers in the city of Bengkalis? And (2) How is the resolution of defaults at Elsa Motor Car Rental between business actors and consumers in the city of Bengkalis? This research uses empirical research methods. This research was carried out directly at the place that was used as the object of the research problem using interviews and observation as data collection tools. The author's research location was Jalan HR. Soebrantas, Wonosari Village, Bengkalis City. Based on the discussion and research, it was found that the implementation of car rental agreements (a) Implementation of Car Rental Rental Agreements in Bengkalis City. In the rental agreement there are rules or articles that have been regulated unilaterally by the company. The contents of the rental agreement are as follows: first party's name, occupation, position, address, nick name, tel/wa. identity of the renter as the second party, name, occupation, address, nickname, telephone number/WA. Vehicle (car) identity, namely, brand/type, year of manufacture, license plate number, frame number, engine number, color. Dispute resolution regarding non-performance in the car rental agreement at the Elsa Motor car rental in Bengkalis City is carried out in two ways, namely litigation, which is a resolution that takes legal and non-litigation or dispute resolution outside of court, the method used is by negotiation and mediation. Negotiation is a way to find a solution to a problem through direct discussion (deliberation) between the disputing parties whose results are accepted by the parties.
