Abstract
The import and trade of second-hand clothing in Indonesia continue to increase despite the government’s prohibition stated in Minister of Trade Regulation No. 40 of 2022, which amends Minister of Trade Regulation No. 18 of 2021 concerning the Prohibition of Exported and Imported Goods. This phenomenon has negatively affected the sustainability of local clothing industries, particularly in Pasar Putih, Bukittinggi City, where the rise of imported second-hand clothing sales has reduced public interest in local products. Such conditions raise a legal issue regarding the effectiveness of trade protection for local products, which should be fully supported by the government under Law No. 7 of 2014 on Trade. The problems discussed in this study are: (1) How is the protection of local clothing trade against the entry of imported second-hand clothing in Bukittinggi City, and (2) What factors cause the widespread trade of imported second-hand clothing in Pasar Putih Bukittinggi. This research employs an empirical legal method with a qualitative descriptive approach. Primary data were obtained through interviews with local clothing traders, imported second-hand clothing sellers, and officials from the Department of Trade and Customs of Bukittinggi City. Secondary data were collected from relevant laws, books, and scientific journals. Data were gathered using interviews and documentation, while analysis was conducted qualitatively with a deductive reasoning method. The results of the study show that the protection of local clothing trade in Kota Bukittinggi has not been effective, as evidenced by the continued circulation of imported second-hand clothing in Pasar Putih despite government prohibitions. The factors causing the entry and trade of imported second-hand clothing include economic factors, social and consumption culture factors, limited employment opportunities, weak supervision and law enforcement, price differences between local and imported second-hand clothing, lack of public legal awareness and weak government socialization, as well as high market demand.
