Abstract

Buying and selling is an agreement by which one party binds himself to deliver a material, and the other party to pay the promised price. Regular buying and selling and online buying and selling are almost similar, the only difference is the communication that is carried out. In online buying and selling, communication is done online. Even though it is carried out online and does not have an agreement letter that regulates between the parties, this online buying and selling activity is not separated from the existence of a binding agreement. Apart from that, it is not uncommon for there to be wanprestadi that occurs in online buying and selling as well as ordinary buying and selling. More concretely, the problem of this research is How is the settlement of default in online buying and selling in Pekanbaru jual beli online (PJBO) and What are the obstacles to the settlement of default in online buying and selling in Pekanbaru jual beli online (PJBO). but the reality that occurs in online buying and selling in Pekanbaru jual beli online (PJBO) is a default committed by the seller in PJBO which has an impact on the buyer because he receives goods not in accordance with what was promised. The type of research used in this research is empirical sociological legal research, carried out by implementing normative legal provisions in practice on every certain legal event that occurs in society. The purpose of this research is to find out the settlement of default in online buying and selling in Pekanbaru jual beli online (PJBO) and to find out the obstacles to the settlement of default in online buying and selling in Pekanbaru jual beli online (PJBO). So to solve the default problem that occurs in PJBO online buying and selling is by negotiation. The settlement of default in online buying and selling in Pekanbaru jual beli online (PJBO) is carried out by means of negotiations from both parties, but if the seller does not carry out the results of the negotiations the parties will continue the problem to the Court. The obstacles in resolving online buying and selling defaults in Pekanbaru jual beli online (PJBO) are that the seller does not have a job and the seller is entangled in online loans.
