Abstract
Law enforcement is expected to serve as a deterrent factor against the spread of drug abuse, illicit trafficking, and the circulation of narcotics. However, in reality, the more intensive the law enforcement efforts carried out by law enforcement officers, the more the distribution and illicit trafficking of narcotics continue to increase. One of the law enforcement institutions that interacts directly with the community is the police. Based on Article 2 of Law Number 2 of 2002 concerning the Indonesian National Police, the police function is one of the functions of state governance in maintaining public security and order, law enforcement, protection, guidance, and service to the community. In addition to the police, Law Number 35 of 2009 concerning Narcotics mandates the establishment of the National Narcotics Agency, hereinafter abbreviated as BNN, which is more operational and has the authority to investigate narcotics abuse and narcotics precursors. The main issues in this study are how law enforcement is carried out against the distribution of cannabis-type narcotics in the jurisdiction of the Binawidya Police Sector, and what obstacles are encountered in the implementation of law enforcement against the distribution of cannabis-type narcotics in the jurisdiction of the Binawidya Police Sector. This type of research is observational research, or what is referred to as a survey method, which is a study that uses interviews as a tool for gathering primary data by taking samples from a population. The nature of the research is descriptive, which means describing the conditions of the research subjects or objects at present based on observable facts as they are. The implementation of law enforcement against the distribution of cannabis-type narcotics in the jurisdiction of the Binawidya Police Sector is based on the Criminal Code (KUHP), Criminal Procedure Code (KUHAP), Law Number 35 of 2009 on Narcotics, Government Regulation Number 40 of 2013, and Supreme Court Circular (SEMA) Number 4 of 2010. The Binawidya Sector Police have carried out their law enforcement functions. Law enforcement, as one form of concretely actualizing legal rules, can be manifested in the social norms of society. One means of enforcing the law is through the application of criminal sanctions. The Binawidya Sector Police consistently emphasize and remind their members not to discriminate and to process anyone involved in narcotics-related criminal acts. The obstacles in implementing law enforcement against the distribution of cannabis-type narcotics in the jurisdiction of the Binawidya Police Sector include several factors: low public legal awareness, uncertain case-handling systems, inadequate facilities and infrastructure, limited operational budget, and limited investigative human resources.
