Abstract

This research is motivated by the increasing circulation of imported secondhand clothing in Pasar Kodim, Pekanbaru, which significantly affects the sustainability of local clothing traders. Although the Indonesian government has issued regulations prohibiting the import of secondhand clothing such as Law Number 7 of 2014 on Trade, Minister of Trade Regulation Number 51 of 2015, and Minister of Trade Regulation Number 40 of 2022 the practice continues to occur widely. This condition creates unfair business competition, reduces the income of local traders, and reflects the ineffective implementation of legal protection at the local level. Therefore, this research aims to examine the effectiveness of legal protection for local clothing traders and identify the factors that contribute to the persistent entry of imported secondhand clothing into Pasar Kodim, Pekanbaru. The research problems are: (1) how the legal protection for local clothing trade is implemented against the influx of imported secondhand clothing in Pasar Kodim, Pekanbaru; and (2) what factors contribute to the continued circulation of imported secondhand clothing in Pasar Kodim, Pekanbaru. This study employs an empirical legal research method with a juridical- sociological approach. Primary data were collected through interviews with 22 respondents, consisting of 10 local clothing traders, 10 imported secondhand clothing traders, one representative from the Pekanbaru Trade Office, and one officer from the Customs Office. Secondary data were obtained from legislation, books, journals, and relevant official documents. The collected data were analyzed qualitatively to provide a comprehensive understanding of the legal implementation and market dynamics. The findings indicate that the legal protection for local clothing traders has not been effectively implemented. Weak government supervision, inconsistent law enforcement, and the absence of economic support for local traders have led to a lack of legal certainty. The study also reveals that the entry of imported secondhand clothing is driven by several interconnected factors, including lower prices, strong consumer demand fueled by the thrifting trend, limited government supervision, low legal awareness among traders and consumers, and the existence of organized distribution networks. Therefore, addressing the issue requires a comprehensive approach that goes beyond normative prohibition by strengthening monitoring systems, increasing legal awareness, and empowering local traders economically.
