Abstract
Article 53 of Law Number 22 of 2001 concerning Oil and Gas regulates certain aspects in the management of oil and gas activities in Indonesia, by reselling subsidized fuel that has been purchased from Pombensin. For this violation, there are administrative sanctions and a period of confinement. that the perpetrator arrested for this abuse violation will be subject to criminal penalties and fines. Nonetheless, there are still individuals who abuse subsidized fuels illegally in various locations. Fuel buyers show up with jerry cans. They appeared because they used the opportunity given to take advantage of Pertamina's irregular fuel distribution because oil was taken on this large scale, with a big impact. The illegal misuse of subsidized fuels aims to benefit oneself by taking advantage of conditions in places where there is a shortage of fuel. The formulation of the problem that the author researches is how to buy and sell fuel oil (BBM) at petrol stations based on Law No. 22 of 2001 concerning Gas and Oil in Bangko District, Rokan Hilir Regency? What are the factors that affect buying and selling oil with jerry cans at petrol stations in Bangko District in the Rokan Hilir Regency area. This research method is the type and nature of the research is legal observational, which means that the study is carried out directly at the research site. The nature of this research is descriptive, meaning that the information researched in the field about the Juridical Review of Buying and Selling Based on the oil and gas law number 22 of 2001 in the sub-district, subsidized fuel oil (BBM) using jerry cans at the Bangko petrol station, Rokan Hilir Regency. The place for this research is the Rokan Hilir petrol station, the reason for researching at the petrol station in Bangko district is because the center where street vendors use fuel jerry cans which is said to grow Micro, Small, and Medium Business Groups in the Rokan Hilir Regency government. The buying and selling of subsidized fuel using jerry cans that occurred at several petrol stations in Bangko District is basically a practice of irregularities in fuel distribution, because it is not in accordance with the licensing provisions and distribution mechanisms that have been stipulated in national petroleum regulations. Law Number 22 of 2001 emphasizes that every oil and gas business activity, including transportation, storage, and distribution of subsidized fuel, must be carried out by parties who have an official license. Based on the findings of the study, there are several main factors that cause the practice of buying and selling subsidized fuel using jerry cans to continue and is difficult to regulate, namely: Economic Factors, Community Needs Factors and very weak supervision factors
