Abstract

The provision of credit with Mortgage Rights as collateral is a guarantee agreement related to the main agreement, namely the credit agreement. This guarantee agreement has an additional nature to the main agreement. The purpose is not only to guarantee the repayment or fulfillment of the debtor's obligations to the creditor, but also to facilitate the resolution of disputes if the debtor fails to fulfill his obligations. The main problem in this study is how legal protection is given to the winner of the auction for the execution of the mortgage object based on Article 6 of Law Number 4 of 1996 at the Pekanbaru State Asset and Auction Service Office (KPKNL) and what are the obstacles faced in implementing legal protection for the winner of the auction for the execution of the mortgage object at KPKNL Pekanbaru. The method in this study is an empirical legal research method, namely research conducted by going directly to the field to obtain information and data through interviews. While the nature of the research is descriptive analytical, namely this research presents a clear, detailed and systematic picture of the problems to be studied. The results of the research obtained are Legal protection for auction winners at KPKNL Pekanbaru, according to Article 6 of Law No. 4 of 1996, aims to ensure that their rights are legally recognized. KPKNL ensures a transparent auction process, provides certificates of ownership, and cooperates with the court to resolve disputes. Although effective, there are still challenges such as lawsuits from debtors and administrative issues that need to be considered to ensure legal certainty. Meanwhile, obstacles to legal protection for auction winners at KPKNL Pekanbaru include lawsuits from debtors or third parties, administrative issues, and delays in resolving disputes in court. The complexity of executing mortgage objects also adds to the challenges in providing legal certainty. To overcome this, better transparency, improved administration, and close cooperation between KPKNL and the courts are needed so that the rights of auction winners are effectively protected.
