Abstract

This research examines case study number 771/pdt.g/2022/pn.jkt.pst, which concerns a case of kidney failure in a child caused by syrup containing hazardous substances in three pharmaceutical industries: PT Yarindo Farmatama, PT Universal Pharmaceutical Industries, and PT Afi Farma, which is a class action lawsuit. In this case, the Food and Drug Monitoring Agency (BPOM) has not yet fully supervised and provided legal protection to consumers, with some pharmaceutical industries producing syrups failing to meet the standards and/or safety requirements set by BPOM. The main issue in this research is how the government oversees legal protection for cases of acute kidney failure in syrup consumers in Indonesia (case study number 771/pdt.g/2022/pn.jkt.pst). Second, how is legal protection for acute kidney failure cases among syrup consumers in Indonesia (case study number: 771/pdt.g/2022/pn.jkt.pst). This thesis employs normative legal research, or a library legal research method. The data collection method used in this study is document analysis. The collected data will be processed using descriptive analysis. The data analysis used qualitative techniques with inductive inference. The results of the study indicate, first, that government oversight of legal protection for consumers consuming syrup medications has impacted the increase in cases of acute kidney failure in Indonesia. The government, in this case the Food and Drug Monitoring Agency (BPOM), has implemented oversight, but it has not been optimal in overseeing drug distribution in Indonesia, particularly in two pharmaceutical industries: PT Afi Farma and CV. Samudera Chemical. Second, legal protection for consumers who consume syrup drugs and have an impact on cases of acute kidney failure in Indonesia that BPOM has not provided maximum protection to consumers both preventively and preventively, as well as court decisions against syrup drug manufacturers in cases of acute kidney failure indicate that legal efforts have been made, but in terms of compensation and accountability and are not in accordance with consumer demands. In addition, BPOM should also be involved in covering consumer losses and is blamed but in fact there is none.
