Abstract

Protection for outsourced workers at PT. Indomarco Adi Prima Pekanbaru. This legal protection is regulated in the employment agreement, and because it is related to outsourcing, the outsourcing company used by PT. Indomarco is PT. Sumber Daya Dian Mandiri or abbreviated as PT. SDM. PT Indomarco and PT. Sumber Daya Dian Mandiri have collaborated to assist PT. Indomarco in running its business. In addition, outsourced workers must receive legal protection for their rights to create welfare for workers/laborers. The normative rights that will be discussed by the author are related to the rights regulated in PP 35/2021 which discusses the Right to Wages, Rights to Occupational Health and Safety, Rights to Leave, Social Security, Menstrual Leave Rights for women, and Overtime Rights. The author has conducted interviews and observations and filled out questionnaires with workers to determine if the rights of workers at PT. Indomarco or outsourced workers at PT. Many of Dian Mandiri's workers still lack legal protection for their rights. The research questions are as follows: 1) How is the legal protection of outsourcing workers' rights provided under Government Regulation Number 35 of 2021? 2) What are the obstacles to fulfilling outsourcing workers' rights? This research employs empirical legal research with descriptive qualitative data analysis techniques. The results of this study indicate that legal protection for outsourcing workers' rights is conducted in accordance with applicable laws and regulations. Among the inhibiting factors in fulfilling workers' rights are the lack of awareness of their rights, wage rights that do not comply with statutory provisions, and the lack of government oversight by the Pekanbaru Manpower Office.
