Abstract
ineral resources, as one of the natural resources, are very important in supporting the Indonesian economy. Nickel commodities are highly needed by many industries, such as the stainless steel industry, batteries, alloy metals, and metal coatings. The downstream mining industry is the process of increasing the added value of minerals produced by the mining sector through processing. The nickel downstream policy aims to optimize Indonesia's nickel potential through the development of smelter and EV industries. In the issues being studied, the author uses 2 problem formulations as a reference for writing, namely the reasons for the issuance of the downstream policy for mining products (nickel), and the inhibiting and supporting factors related to the downstream policy for mining products (nickel). This type of research falls into the category of normative legal research or can also be referred to as doctrinal legal research. The method used in this research is through library research or document studies. In this case, the researcher must be observant and precise in finding data found both in regulations and in literature that has a relationship with the issues being studied. The researcher draws a conclusion deductively, which means drawing conclusions from general to specific matters, where the two facts are bridged by existing theories. Nickel as a non-renewable natural resource is increasingly needed and is being regulated due to its limited reserves. The Indonesian government is striving to fulfill the welfare and prosperity of the people fairly based on the 1945 Constitution of the Republic of Indonesia Article 33 paragraph (3). The downstream policy can have both negative and positive impacts depending on how the policy is viewed. The existence of the downstream policy can be a breath of fresh air for mining entrepreneurs but also serves as a barrier for the mining results, namely nickel itself, to be excessively explored. However, downstreaming can also lead to pros and cons if not addressed properly, even providing entirely negative impacts on the mining process itself.
