Abstract

This thesis examines the Legal Analysis of the Provisions on Psychological Violence in Article 7 of Law Number 23 of 2004 concerning the Elimination of Domestic Violence. The main problem in this study is how the legal provisions regarding Psychological Violence in Law Number 23 of 2004 concerning the Elimination of Domestic Violence and how the legal analysis of the application of Article 7 of Law Number 23 of 2004 in providing Legal Protection for Victims of Psychological Violence in the Household. This study uses a normative legal research method, which is a method used in legal research that is carried out by examining library materials consisting of primary legal materials, secondary legal materials and tertiary legal materials. From the results of the study, it can be concluded that, 1) The Legal Provisions regarding Psychological Violence in Law Number 23/2004 concerning the Elimination of Domestic Violence show that protection for victims of domestic violence also includes forms of violence that attack a person's psyche. However, in terms of regulatory structure, this law has not been followed by adequate technical provisions to further explain the forms of psychological violence, its legal parameters, and the procedures for providing evidence that can be used. Due to the absence of implementing regulations such as government regulations, ministerial regulations, or technical procedures at the investigation and trial levels that explain in detail about psychological violence, the provisions in this law are still general in nature or limited to legal recognition alone. The impact is that even though psychological violence has been regulated by law, victims still have difficulty getting real protection and justice in the field. 2) Regarding the Legal Analysis of the Implementation of Article 7 of Law Number 23/2004 in providing Legal Protection, its implementation still faces various serious obstacles that hinder the effectiveness of law enforcement. The obstacle is the difficulty in proving psychological violence due to the absence of real physical injuries, where the victim requires examination by a psychologist/psychiatrist, whose number is limited. The low understanding of law enforcement officers regarding the forms and impacts of psychological violence causes many victim reports to be directed to the peaceful path without legal process. The absence of standard operating procedures (SOP) that technically regulate reporting, investigation, and the process of proving psychological violence. This causes the implementation of Article 7 to be inconsistent and ignores the rights of victims.
